Welcome to The Watch Farm (the “Site”), operated by Apricot Fresh LLC, a Delaware limited liability company (“Apricot Fresh,” “The Watch Farm,” “we,” “us,” or “our”).

By accessing or using the Site, or by purchasing any product from us, you (“you,” “your,” or “Customer”) agree to be legally bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, please do not use the Site.

5.3 We reserve the right to:

  • Limit the quantities of any products we offer;

  • Discontinue any product at any time; and

5.4 Prices on the Site are listed in U.S. dollars (USD) and may include or exclude applicable taxes and shipping charges. The final amount, including any taxes and shipping fees, will be shown at checkout.

6.2 We reserve the right, in our sole discretion, to accept or reject any order for reasons including, but not limited to:

6.3 If we cancel or cannot fulfill your order after you have been charged, we will refund the applicable amount to your original payment method.

7.4 You are responsible for any fees charged by your bank, card issuer, or payment provider, including foreign transaction fees if applicable.

8. Shipping, risk of loss, and delivery

8.1 Our Shipping Policy, published on the Site, is incorporated into these Terms by reference. It describes the shipping methods, costs, and estimated delivery times.

8.2 Risk of loss and title to products pass to you when the carrier records your order as delivered to the shipping address you provided.

8.3 We are not responsible for delays or failures in delivery caused by:

  • Carriers, customs, or other third parties;

  • Incorrect or incomplete shipping information provided by you;

  • Events beyond our reasonable control (including natural disasters, strikes, or other force majeure events).

8.4 If a package is returned to us because of incorrect address details or failed delivery attempts, we may ask you to pay any additional shipping costs for re-delivery.

9. Returns, refunds, and exchanges

9.1 Our Refund & Returns Policy, published on the Site, is incorporated into these Terms. It explains the conditions, time-frames, and methods for returns, refunds, and exchanges.

9.2 To the extent permitted by law, we are obligated to honor returns and refunds only as described in our posted Refund & Returns Policy in effect at the time of your purchase.

10. Promotions, discount codes, and gift cards

10.1 Any promotions, discount codes, or special offers are subject to additional terms and conditions, including:

  • Eligibility requirements;

  • Validity period and expiration date;

  • Limits on the number of times they may be used;

16.2 Our total aggregate liability for any claim arising out of or relating to the Site, the products, or these Terms shall in no event exceed the amount you actually paid to us for the order giving rise to the claim.

16.3 Some states do not allow limitations on certain damages. In such states, our liability will be limited to the greatest extent permitted by law.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severed from these Terms and will not affect the validity and enforceability of the remaining provisions.

20. Entire agreement

These Terms, together with any policies or notices posted on the Site (including our Privacy Policy, Cookie / Tracking Policy, Shipping Policy, and Refund & Returns Policy), constitute the entire agreement between you and us regarding your use of the Site and our products, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
